- In terms of the Protection of Personal Information Act, 4 of 2013 (“POPI”) it is important to take note of the following when processing personal information of patients:
SECURITY & ACCESS
- The practice must take all reasonable and appropriate technical and organisational measures to protect the personal information held by the Practice, both physically and electronically, in order to prevent loss, damage and/or unauthorised destruction of personal information; and unlawful access and/or processing of personal information.
STORAGE & DESTRUCTION
- The practice must ensure that all Personal Information held by the Practice is stored, retained and destroyed in accordance with the legislation applicable to the specific information.
- Personal Information shall not be retained longer than required to fulfil the purpose for the which it is processed, or longer than the period for which the consent was given. In instances where a time period is prescribed by legislation, the Personal Information will not be processed or retained longer than required by Applicable Legislation. Thereafter, the Personal Information must be destructed and/or deleted and/or returned to the Data Subject as may be required by the Applicable Law and in a manner that complies with such Applicable Law.
